Do I need a lawyer to deal with my own insurance company?

It depends. The insurance adjuster under your own auto policy is responsible to help process and secure the benefits that you need in order to get better. Often the insurance company will discourage you from seeking out a lawyer’s services. This may put you at a disadvantage because you may not understand all of the benefits available to you. It is not uncommon for the insurance company to tell you that your injuries are minor and therefore don’t need a lawyer. If you are injured in a motor vehicle accident it is important for you to consult with a lawyer so that you may understand the potential value of your case and the benefits to which you may be entitled.

Can I settle an accident benefits claim with my own insurance company without a lawyer?

You certainly have the right to do so but I wouldn’t recommend it. Insurance companies often minimize the value of your claim in an effort to close their file. It may not be the appropriate time for you to resolve your case because you have not reached your maximum medical recovery. If your insurance company is asking you to sign a release and settle your case you should consult with a personal injury lawyer before doing so.
